It is not uncommon for banks, insurance companies, and other financial institutions to violate the law. These laws may concern lending, sales, or other business practices.
Companies sometimes sell a poorly manufactured or defective product that leads to consumer injuries. Other times, businesses will engage in deceptive advertising and/or fail to reveal certain fees.
If you have been the victim of bank fraud, a faulty product or false advertising, you may be able to seek recourse in court by filing a consumer fraud claim.
CONSUMER FRAUD AND CLASS ACTION SUITS
Consumer fraud and consumer class action lawsuits are civil actions brought on by one or more individuals on behalf of themselves and a larger group that has been the victim of the same or comparable experience.
The purpose of a class action is to secure a judicial remedy with the goal of eliminating the injury or wrongdoing to the involved individuals. A class action seeks to compensate these individuals for their suffering, and can involve hundreds, or even millions of people with similar claims. When a court certifies a class action, it allows all these different claims to be heard and ruled on in one trial.
Some common instances of fraud include:
Insurance fraud: Insurance companies are expected to provide for their policyholders when they become injured, have suffered property loss or other injury or disaster. However, sometimes in the face of a catastrophe an insurance company will say that the claims are unwarranted or not covered, and will refuse to pay the victims. Insurance fraud is a serious crime, and the experienced consumer fraud lawyers at Jacoby & Meyers will fight to protect your rights.
Automobile fraud: An automobile dealership can misrepresent or fail to reveal the true condition of a used vehicle, such as if it were in an accident and sustained damage. Mileage can also be falsified and the odometer tampered with. Automobile fraud may also occur when a dealership promises to provide financing options, then fails to do so and refuses to return your down payment or declines to trade in that vehicle.
Investor fraud: There are various types of stockbroker misconduct that constitute fraud. Some of these include misrepresentations and omissions, unauthorized trading, and recommending unsuitable investments. If you have been the victim of stock fraud, we can file a claim with the appropriate regulatory agency.
Other areas of fraud and misconduct include:
* Truth-In-Lending Act violations
* Deceptive and Unfair Trade Practices Act violations
* Defective Products

Whether you are entering the job market for the first time or were recently terminated, it is important to understand your rights as a worker. Federal and state governments have employment laws protecting employees from discriminatory treatment, unfair labor practices, unsafe work conditions, and more.
Employment law issues can arise in a wide range of situations. One of the most common circumstances occurs when an employee is fired for an illegal reason. Under federal law, employees may not be terminated on the basis of their race, gender, ethnicity, religion, disability or age. Employers who do so may be subject to civil liability for wrongful termination. The ban on discrimination applies not only to firings, but to other aspects of employment, including hiring and promotion decisions.
Federal and state laws also protect employees from unfair labor practices. Employers must comply with wage and hour laws that define  how long an employee can work and how much he or she must be paid. Employees’ rights extend to family life as well. For example, the Family and Medical Leave Act ensures that employees are granted time off to welcome a new baby, or deal with illness.
Other employment law issues involve workplace conditions. For example, employers must provide a safe workplace by adhering to national safety standards. Failing to do so can lead to fines and civil liability. In addition, employees generally have certain privacy rights while at work. For example, employers typically can’t monitor personal telephone conversations or search an employee’s car.
If you or a loved one is involved in an employment law dispute, consult with Trusted Employment Lawyer. Because employment is such a broad area of the law, employment lawyers typically specialize in one or a few aspects of practice. It’s therefore important for you to seek out a Trusted Lawyer who is experienced in the relevant area of employment law. For example, if you feel that you’ve been the victim of workplace discrimination, you should seek out a Trusted Employment Lawyer who has experience handling the type of discrimination claim you’re bringing. Wills, Trusts & Estates Law

A Trusted Lawyer with expertise in wills, trusts and estates can help you through the complex issues surrounding these legal documents. A will is a legally binding document, created and signed by an individual for the purpose of distributing their property and assets upon their death. This individual is referred to as the “testator” or “decedent.” The will contains instructions for how the testator’s property and assets (“estate”) are to be distributed after the testator’s death. It also specifies to whom what specific assets are to be distributed.
A Trusted Lawyer can draft you a will and it is recommended that every adult have a will, especially those with significant assets.
Upon the testator’s death, the will is submitted to a court to be “probated” (i.e, “proven”). Generally speaking, the probate process begins with submitting the will to a probate court. To “probate” a will is to distribute the decedent’s property in accordance with the will’s terms. The probate proceeding is the means through which the judge gives the legal approval for the property distribution.
What are Will Settlements?
In an ideal situation, the will’s terms are clear, the judge approves the distribution, and each party who was given a distribution under the will (i.e., beneficiaries) receives the distribution, without any argument.
Often, though, once the testator has died, disagreements regarding the distribution of money or property occur, typically among family members, who either did inherit something from the will, or did not inherit something but believe that they should have. Such disagreements are resolved by a process known as will settlement.
What Types of Will Settlement Procedures Exist?
Will settlements may occur privately, or through court. Private settlement involves negotiation between the executor (the individual tasked with the distribution of the estate) and those individuals who have taken issue with what was, or what was not, distributed to them under the will. Private settlement can consist of these parties directly talking to each other to resolve disagreements.
A dissatisfied party can contest a will in court. Will contests are heard by special judges known as probate judges. These judges resolve contested issues by applying the relevant law so as to best give effect to what the testator’s wishes regarding distribution were.
Will contests, not uncommonly, subject parties to significant court costs and attorneys’ fees. These proceedings may also take months or even years before they are resolved.
How do Will Contests Work?
In a will contest, a dissatisfied party challenges part or all of the will on specific grounds.
What is Estate Planning and How Does it Relate to Will Settlement?
Estate planning consists of the actions taken by a testator to prepare for the disposition of their estate. These actions include drafting wills and trusts that specify who will inherit the testator’s estate. An estate includes the entirety of a person’s wealth and assets, including land, money, insurance, investments, personal and real property, and debts.
Will settlement frequently requires resort to documents created as part of the estate planning process. For example, if a will indicates certain property is to be disposed of by trust, the trust document that was created during estate planning may be examined. This can help to resolve the dispute. Estate planning documents thus may provide information that is relevant to, and is in some cases necessary for, will settlement.
Do I Need a Lawyer for Help with Will Settlement Issues?
Will settlement can involve complex legal issues related to wills, trusts, estates, and estate planning. The process may seem overwhelming. If you seek to settle a will, or are (or are to become) a party to a will settlement, you should consult with a wills, trusts, and estates attorney. This type of lawyer has knowledge of wills, trusts, and estate planning, and can assist you with will settlement issues.

Real estate dealings may be fraught with difficulties and legal concerns based on various factors such as deed claims, special interests, disclosing defects and problems and financing. If someone else has a claim on the property at the time of the sale, the buyer may be facing complications in holding onto the house he or she has just purchased.
Any problems with the land or house may be kept from the buyer to attract more attention or to deter a survey or assessment of the property. While this may not be legal, some sellers still attempt to do so when showing the house. Mortgages and loans for financing the deal may be difficult to obtain or maintain.
Buying and selling real estate usually occurs with lawyers, brokers, real estate agents and the buyer and seller. There is generally various forms of documentation that must be filled out by each party, and then the lawyer needs to analyze the files to ensure they are valid and free of legal issues.
When the buyer is attempting to purchase the property, he or she typically needs to secure funding through a legitimate financing agency. In certain situations, this is not necessary, but if primary funding institutions are not available secondary sources may be used. While most complications don’t arise until after the paperwork is finalized, a legal representative may discover a problem before this occurs and halt the sale. That means it is crucial in hiring a lawyer to assist with these transactions.
Incompetent Agents: When a relationship forms between the buyer and seller, these two parties often rely on brokers, real estate agents and real estate lawyers to assist with the documentation, processes and ensuring everything is legal. However, if the agent in charge of one aspect of these arrangements is incompetent, this makes the proceedings difficult to finalize. If this person is the real estate agent, there could be an issue from the paperwork to the actual property. This means that the defects may not be fully disclosed even if this is necessary by state law. If the issue is with another agent, this could mean complications in securing financing for the buyer or ensuring the documentation is valid for the seller.
Other difficulties may arise if there are not certain provisions in the files signed by both parties. This may lead to problems with ensuring the deed is free of previous owners or interests. If there are easements that have not been clarified with the buyer, he or she may be illegally stopping traffic through his or her property for a commercial business. There are situations where the real estate agent may knowingly or unwittingly forces the buyer into a certain price range or location where he or she must purchase only certain properties. In many states, this is illegal and could cost the agent his or her license and cause negative impacts to the agency.
A Trusted Real Estate Lawyer should become part of the proceedings to help you find solutions to many real estate related issues.
